Terms of Service

These Terms of Service govern your access to and use of Dignita. Please read them carefully — by using the service you agree to them.

1. Who we are

2. What the service is — and is not

Dignita is a software tool that helps South African households employ a domestic worker compliantly — generating contracts, payslips, UIF, COIDA and leave documents and guidance.

Not legal, tax or financial advice

Dignita is a compliance tool, not a law firm, labour consultant, accountant or financial-services provider. The documents, figures and guidance it produces are based on our understanding of current South African legislation and are provided for general information only. They are not legal, tax or financial advice and do not create a professional relationship. You should confirm your specific situation with a qualified professional. Dignita does not move, hold or process wages — you pay your worker yourself.

3. Eligibility & accounts

  • You must be at least 18 years old and able to enter into a binding contract.
  • You are responsible for the accuracy of the information you enter, and for keeping your login credentials secure.
  • You are responsible for activity under your account. Tell us promptly at [SUPPORT EMAIL] if you suspect unauthorised use.

4. Acceptable use

You agree not to:

  • Use the service unlawfully, or to process personal information you are not entitled to process.
  • Attempt to access data belonging to other households or workers, or to circumvent our security or access controls.
  • Interfere with, disrupt, reverse-engineer or place an unreasonable load on the service.
  • Upload unlawful, infringing or malicious content.

5. Employer and worker responsibilities

As the employer you remain the employer of your domestic worker under South African law. You are responsible for paying lawful wages, registering and paying UIF and COIDA where applicable, and meeting your obligations as a Responsible Party for your worker’s personal information. The service helps you do this but does not assume these obligations for you.

Where a worker is given access to their own data, that access is enabled by the employer and is read-only and limited to the worker’s own approved employment data.

6. Subscriptions, trials & payment

  • Some features are free; premium features require a paid subscription. Current pricing is shown in the app.
  • We may offer a free trial. Unless you cancel before it ends, your subscription may continue on the terms shown at sign-up.
  • Payments are processed by PayFast. Subscriptions renew automatically until cancelled.
  • Billing, cancellation and refunds are governed by our Refund & Cancellation Policy.
Your statutory rights under the Consumer Protection Act and ECTA — including cooling-off rights for certain electronic transactions — are not excluded by these terms. See our Refund & Cancellation Policy.

7. Intellectual property

The service, its software, branding and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the service for its intended purpose. Documents you generate for your own employment use are yours to use for that purpose.

8. Disclaimers & limitation of liability

The service is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude implied warranties and are not liable for indirect, incidental or consequential loss, or for any consequences of relying on outputs you did not verify with a professional.

Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including under the Consumer Protection Act. Where the law implies non-excludable rights, those prevail over anything inconsistent here.

9. Suspension & termination

You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these terms or use the service unlawfully. On termination, the parts of these terms that by their nature should survive (such as liability and intellectual property) will continue to apply.

10. Governing law & changes

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. We may update these terms; the “Last updated” date shows when they last changed, and continued use after a change means you accept the updated terms.
